These Terms and Conditions (“Terms”) govern the rental of villa properties (“Accommodation”) provided by us (“we,” “us,” or “our”) to you, the individual or group making the booking (referred to as “Guest,” “you,” or “your”). By confirming a booking, you agree to be bound by these Terms.
1. Definitions
- Accommodation: Refers to the villa, property, or rental unit provided to the Guest under these Terms.
- Booking: A confirmed reservation for Accommodation once payment is received.
- Confirmation: An email or notification sent to the Guest upon receiving payment, formally acknowledging the Booking.
- Deposit: A partial payment required to confirm a Booking, typically 50% of the total rental fee.
- Security Deposit: An additional refundable payment collected to cover any potential damages or additional charges.
- Cancellation: The process of terminating a Booking, either by the Guest or by us under specific conditions.
- Force Majeure: Events or circumstances beyond reasonable control, such as natural disasters, government actions, or pandemics, which may impact the provision of services.
2. Booking Agreement
- By submitting a Booking request and paying the required Deposit, the Guest enters into an agreement with us to rent the specified Accommodation.
- Confirmation of the Booking is only valid once a Confirmation email is sent. Bookings are not guaranteed until payment and confirmation are completed.
3. Payment Terms
- Payment terms will be outlined in your booking confirmation email and are in line with the Villa Management (Third Party Provider) of your chosen villa.
- Deposit: A deposit amount outlined in your booking confirmation is required within 3 business days of making the booking.
- Balance Payment: The remaining balance is due 75 days prior to the arrival date unless stated differently in your Booking Confirmation email. If the Booking is made within 75 days of the arrival date, full payment is due at the time of booking.
- Accepted Payment Methods: Payment can be made via credit card, bank transfer, or any other methods specified at the time of booking. All fees related to payments are the responsibility of the Guest.
4. Cancellation and Refund Policy
- All Cancellations and Refund requests will be handled in accordance with the Cancellation and Refund Policy in place with the Villa Management (third party provider) of the Villa you have rented. This information is provided at the time of booking and is subject to change and update at anytime by the Villa Management (third party provider) and UBE are not responsible for any changes made or fees involved with Cancellation and Refund requests.
- No Refunds for Early Departures: If the Guest departs earlier than scheduled, no refund will be provided for the unused nights.
- Travel Insurance Recommendation: We highly recommend that Guests obtain travel insurance to cover unexpected circumstances, as the above cancellation terms in line with each third party provider are non-negotiable.
5. Maximum Occupancy and Guest Conduct
- Occupancy Limits: Each Accommodation has a specified maximum number of guests permitted. The Guest agrees not to exceed this limit without prior approval, which may incur additional charges.
- Conduct: Guests are expected to respect the property and avoid behaviour youthat may disturb neighbours or cause damage to the property. Any violation may result in the termination of the stay without refund.
- Additional Guests: Any increase in the number of guests beyond the agreed occupancy must be approved in advance and may be subject to additional charges.
6. Security Deposit and Damages
- Security Deposit: A refundable Security Deposit may be required before or upon arrival. The amount and terms will be specified at the time of booking.
- Refund of Security Deposit: The Security Deposit will be refunded within 14 days of check-out, provided there are no damages or additional charges incurred. Any deductions will be documented and communicated to the Guest.
- Guest Responsibility for Damages: Guests are responsible for any damage caused to the property beyond normal wear and tear. If repair or replacement is required, the cost may be deducted from the Security Deposit or charged separately.
7. Check-In and Check-Out Procedures
- Check-In Time: Check-in is available from 3:00 PM on the arrival date.
- Check-Out Time: Check-out is required by 11:00 AM on the departure date.
- Late Check-Out: Late check-outs may be possible, subject to availability, and may incur additional fees. Requests should be made as early as possible.
8. Limitation of Liability
- Guest Responsibility: Guests use the property, facilities, and pool at their own risk. We accept no liability for accidents, injuries, or losses incurred during the stay, except as required by law.
- Valuables: Guests are advised to secure valuables in the available safe or retain them when not in residence.
- Liability Waiver for Pool Use: Guests using the pool facilities do so at their own risk. Parents and guardians are responsible for supervising children in and around the pool area.
9. Compliance with Indonesian Law
- Local Laws: The Guest agrees to abide by all local laws and regulations, including restrictions on prohibited substances.
- Legal Jurisdiction: Any legal disputes related to these Terms will be governed by the laws of Indonesia.
- Prohibited Substances: Indonesia enforces strict penalties for drug-related offenses. It is the responsibility of the Guest to comply with these regulations, and violations may result in immediate termination of the stay without refund.
10. Force Majeure
- Uncontrollable Events: We are not liable for cancellations, delays, or modifications caused by events beyond our control, including but not limited to natural disasters, government restrictions, or health pandemics.
- Alternative Arrangements: In the event of a Force Majeure, we will make reasonable efforts to provide alternative Accommodation. However, we cannot guarantee availability or compensation beyond the refund of any unused rental fees.
11. Special Requests and Additional Services
- Additional Services: Requests for services such as airport transfers, extra beds, or event hosting should be made at the time of booking. Availability and charges for such services vary.
- Special Events: Guests planning events (such as parties) on the premises must notify us in advance. Additional charges, permits, or conditions may apply.
12. Changes to Terms and Conditions
- We reserve the right to update these Terms and Conditions at any time. Updated Terms will be posted on our website and apply to all future bookings.
- Guests are encouraged to review the Terms regularly to stay informed of any changes.
